Acceptance of these Terms

These Terms of Use ("Terms") govern your use of the hydra-tap.com website (the "Site"), operated by Hydra-Tap ("Hydra-Tap," "we," "us"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Informational purposes; no professional advice

Content on the Site — including product specifications, flow charts, engineering data, guides, and other resources — is provided for general informational purposes only. It is not engineering, code-compliance, or safety advice, and it is not a substitute for the judgment of qualified fire protection professionals.

Fire protection work is governed by applicable codes and standards (including NFPA standards) and by the requirements of the authority having jurisdiction (AHJ). You are responsible for verifying all data, calculations, and product suitability for your application, and for complying with all applicable codes, standards, and AHJ requirements. Specifications are subject to change without notice.

Products and purchasing

Hydra-Tap products are sold through our independent distributor network. Nothing on the Site constitutes an offer to sell, and listing a product does not guarantee availability. Terms of sale — including pricing, delivery, returns, and warranty — are established at the point of sale and in the documentation provided with the product. Distributors are independent businesses, and we are not responsible for their acts, omissions, or terms.

FireWatch software

The FireWatch™ application may be subject to additional terms, including an end-user license agreement and the terms of the app store from which you download it. If those terms conflict with these Terms with respect to the App, the App-specific terms control.

Intellectual property

The Site and its content — text, graphics, logos, images, product designs, and software — are owned by Hydra-Tap or its licensors and are protected by intellectual property laws. Hydra-Tap™, FireWatch™, and our product names and logos are trademarks of Hydra-Tap. You may view and print Site content for your own business or personal reference, but you may not reproduce, distribute, modify, or use it commercially without our written permission.

Acceptable use

You agree not to misuse the Site — including attempting to gain unauthorized access, interfering with its operation, scraping content at scale, or using it for any unlawful purpose.

Third-party links

The Site may link to third-party websites, including distributor sites and app stores. We do not control and are not responsible for their content or practices.

Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. THIS SECTION APPLIES TO THE SITE AND ITS CONTENT; PRODUCT WARRANTIES, IF ANY, ARE STATED IN THE DOCUMENTATION PROVIDED WITH THE PRODUCT.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HYDRA-TAP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM OR RELATING TO YOUR USE OF THE SITE OR RELIANCE ON ITS CONTENT. OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Assumption of risk; indemnification

Hydra-Tap products are professional equipment used with pressurized water systems and fire protection infrastructure. Their use involves inherent risks, including risk of property damage, personal injury, or death, particularly if products are installed, operated, or maintained improperly, used with incompatible systems, or used in violation of applicable codes, standards, or manufacturer instructions. By purchasing or using Hydra-Tap products, you acknowledge and assume these risks.

TO THE FULLEST EXTENT PERMITTED BY LAW, BY PURCHASING OR USING HYDRA-TAP PRODUCTS OR USING THE SITE, YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS HYDRA-TAP AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND DISTRIBUTORS FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, LOSSES, LIABILITIES, DAMAGES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) — INCLUDING CLAIMS FOR PERSONAL INJURY OR DEATH — ARISING OUT OF OR RELATING TO: (a) YOUR USE, MISUSE, INSTALLATION, OR MAINTENANCE OF ANY HYDRA-TAP PRODUCT; (b) YOUR FAILURE TO FOLLOW PRODUCT INSTRUCTIONS, APPLICABLE CODES AND STANDARDS, OR AHJ REQUIREMENTS; (c) YOUR USE OF THE SITE; OR (d) YOUR VIOLATION OF THESE TERMS. SOME JURISDICTIONS LIMIT THE ENFORCEABILITY OF INDEMNITY OR ASSUMPTION-OF-RISK PROVISIONS, IN WHICH CASE THIS SECTION APPLIES TO THE MAXIMUM EXTENT PERMITTED.

Governing law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. Any dispute relating to these Terms or the Site will be resolved in the state or federal courts located in Oregon, and you consent to their jurisdiction.

Changes

We may revise these Terms at any time by updating this page. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
